Charge: Possession of drugs with intent to distribute - Felony, up to 7 years in prison.
Location: Derry District Court
Result: Charge reduced to misdemeanor non-possession drug charge. Client still eligible for finanical aid, and all jail time suspended for good behavior.

Charge: Disorderly Conduct - Class A misdemeanor
Location: Nashua District Court
Result: Charge dismissed at day of trial after filing numerous pre-trial motions.
Charge: Simple Assault - Class A misdemeanor
Location: Nashua District Court
Result: Charge dismissed on day of trial after notifying the Court of potential criminal acts by alleged victim.

Charges: 2 counts Simple Assault, criminal mischief, criminal threatening with a shotgun.
Location: Manchester District Court
Result: Jail time all suspended for good behavior, and restitution for property damage.

Charge: Class B Felony - Possession of Narcotic, and Felony Theft
Location: Merrimack District Court
Result: Felony theft Reduced to Misdemeanor. Jail Sentence completely suspended upon good behavior, $620 fine. Felony possession of drugs charge dismissed.

Charge: Class B Felony - Possession of Cocaine
Location: Manchester District Court
Result: Reduced to Misdemeanor. Jail Sentence completely suspended. $438 fine.
Charge: Class A Misdemeanor - Penalty Enhancement to Class B Felony: Indecent exposure.
Client charged with indecent exposure. Due to previous conviction would be facing a Class B Felony.

Result: Not Guilty After Trial

Charge: Class B Felony - Burglary
Client charged with burglary for breaking into a house and taking his own property. After arguing that this should not be considered burglary, the State reduced to a misdemeanor tresspassing.
Location: Manchester District Court
Result:Jail time all deferred. Client able to leave Court a free man.
Date: April 2010
Charge: Class A Misdemeanor - Criminal Threatening (Domestic violence), Stalking (domestic violence), & Contempt of Court/ Violation of bail conditions.
Facts: Client member of military and any domestic violence conviction would have prevented him from deploying. Attorney Hynes argued that Client could not be found guilty based solely on an uncorroborated confession.
Location: Manchester District Court
Result: All Charges Dismissed. Client can remain in military and keeps from not having any criminal record.
Charge: Class A Misdemeanor - Disorderly Conduct
Facts: Client allegedly drunk and engaged in a previous fight, was yelling outside a bar to his friend "I'm not your fucking bro". Client accused to yell obscenities after being told by police to stop. Due to New Hampshire's overbroad, and possibly unconstitutional law, client was charged with disorderly conduct for "Making loud or unreasonable noises in a public place, or making loud or unreasonable noises in a private place which can be heard in a public place or other private places, which noises would disturb a person of average sensibilities"

Date: March 2010
Charge: Reckless Driving
Facts: Client accused essentially of road rage; accelerating quickly in a parking lot and almost causing an accident. A conviction would have carried a mandatory 60 day license loss. Client needs driving license for job and a conviction to that would have cost him his job.
Location: Manchester District Court
Result: Charged amended to negligent operation. No license loss! Client able to keep job.
Charge: Misdemeanor - Two counts of Shoplifting (Wilful Concealment)
Facts: Client has her green card and has been in the Country less than 5 years. Shoplifting is considered a "crime involving moral turpitude" pursuant to federal immigration law and guidelines. If Client was found guilty she would be deportable, and probably at a minimum face deportation proceedings, and likely deported. Attorney Hynes got one count dismissed, and the other charge amened to a violation so there will not be immigration consequences.
Location: Merrimack District Court from Bedford arrest.
Result: Charged reduced to violation. Client will not be deported!
Charge: Felony - Attempted Rape of a Minor
Facts: Client charged with attempted rape of a minor and statutory rape of two other girls. State argued for a high bail amount as they consider client dangerous. State argued just for Cash bail, meaning client would have to post the amount in cash. Attorney Hynes argued for cash/surety bail, so that Client can use a bailbondsmen and not have to post the full amount of case. Attorney Hynes argued to lower the bail amount due to Defendant's personal conditions.
Result: Bail modification lowered by $5000 and bail was set as cash/surety so Defendant can use bail bondsman to get posted and remain free pending what will likely be a long pretrial.
Charge: Class B Felony - Criminal Threatening
Facts: A condition of bail was that the Defendant had to remain 100 yards from the victim. Unfortunately, Defendant's house is next to victim's, and accordingly he could not go to his own house. Attorney Hynes argued to have the previously bail amended to allow for a shorter distance so that client can return to his home.
Location: Manchester District Court.
Result: Bail modification allowed. Client allowed to return to his home!
Charge: Protective Order (Restraining Order)
Facts: Victim filed for and was issued a temporary restraining order. Attorney Hynes recommended Client fight the restraining order.
Location: Manchester District Court.
Result: Protective Order dismissed!
Charge: Class A Misdemeanor - Facilitating an underage drug or alcohol party.
Facts: Client had a party with numerous underage people in possession of alcohol.
Location: Nashua District Court.
Result: Reduced to a violation! Client gets to keep a clean criminal record, and the entire fine was suspended upon good behavior.
Date: February 2010
Charge: 6 Various Class A Misdemeanors including Resisting Arrest, Facilitating an underage alcohol party, and violation of bail conditions.
Facts: Underage Client charged with having a house party with underage people possessing alcohol and resisting arrest. A few weeks later, Client again charged with same offenses, but this time also with violating his previous bail conditions because he was charged with a crime while out on bail.
Location: Nashua District Court
Result: Attorney Hynes got all of the charges dismissed except for one count of resisting arrest and one count of facilitating an underage alcohol party. Both charges were reduced to a Class B Misdemeanor, so Client only paid a fine and will not have to serve any jail time.
Charge: Class A Misdemeanor - Criminal Mischief (Domestic Violence).
Facts: Client damaged property of another.

Charge: Class A Misdemeanor - Disorderly Conduct
Facts: Client involved in "Road Rage" incident.
Location: Derry District Court
Result:Charge reduced to violation level offense so that Client will continue to not have a criminal record.
Charge: Class A Misdemeanor - Simple Assault - Domestic Violence
Facts: Client pushed his partner, causing no bruises or physical injury. Partner did not want to press charges, but the Police arrested Client anyway after the neighbors called the police due to shouting. Client charged with Simple Assault for causing unprivileged contact. Trial was originally set for more than 3 months from the date of the offense. In the meantime, client had to give up his firearms and could not contact his partner, whom he lived with. Because of this, Client had to move out of his apartment.
Location: Manchester District Court
Result:Attorney Hynes filed a motion to move up the Court date by a couple of months so that Client could go home again and see his partner. The charge was dismissed with the condition that Client undertake a domestic violence evaluation.
Charge: Class A Misdemeanor - Simple Assault
Facts: Client hit partner and grabbed the phone from his hand.
Location: Nashua District Court
Result: Attorney Hynes got a plea agreement where the charge would be dismissed as long as Client undertook family counseling. The no contact order was removed.
