Whether the Theft is a Misdemeanor or Felony will usually depend on which crime it is, the amount involved, any prior convictions, and other factors specific to that crime. Besides facing a fine and incarceration, theft crimes usually involve restitution to the victim.

Facts: State claimed Client took property from goodwill. State claimed this was receiving stolen property

Result: Not Guilty! Attorney advised client to go to trial as the State could not prove the property was stolen at the time Client took possession of it. At the end of the State's case, Attorney Hynes argued they had not met their burden, and the Judge entered a Not Guilty verdict.
